Law360 has published the article “Inside New ITAR Rules For US Defense Service Providers,” written by Akin Gump partner Tamer Soliman, counsel Mac Fadlallah and associate Alan Hayes, all members of the firm’s international trade practice.

The article addresses the Department of State Directorate of Defense Trade Controls’ proposed rule amending the International Traffic in Arms Regulations with respect to the provision of defense services by U.S. persons working for non-U.S. entities. The State Department is seeking public comments on the rule by July 27.

As the authors note, U.S. employees of unaffiliated non-U.S. companies are disproportionately impacted by this proposed rule. Additionally, the rule does not provide a practical path to compliance for such companies.
