“Projections, Forward Looking Statements and Safe Harbors: A Review and Analysis of The Valuation Treadmill,” an article by Akin investment management partner James Deeken has been published by Thomson Reuters’ Securities Regulation Law Journal.
The article, which discusses UCLA Law Professor James J. Park’s book The Valuation Treadmill: How Securities Fraud Threatens the Integrity of Public Companies, touches on a series of points and proposals raised by Prof. Park in his book concerning the nature and challenges of projections and forward looking statements. In addition to a case study involving Apple and an early 1980s securities settlement involving liability for failing to meet a projection, James discusses other case studies analyzed by Prof. Park involving Xerox and Enron.
