Daily Journal Again Names Neal Marder a ‘Leading Commercial Litigator’

Akin disputes & investigations partner Neal Marder has been selected among Daily Journal’s ‘Leading Commercial Litigators’ for the second year in a row. This annual supplement looks to honor "the best attorneys working within the broad scope of commercial and bet-the-company litigation across the country.”
In its profile of Neal’s accomplishment, Daily Journal noted he and his team’s success in securing the dismissal of a class action lawsuit filed by California homeowners against Apollo Investment Corp.-owned Golden Bear Entities. The homeowners accused the entities of violating California laws through the Property Assessed Clean Energy (PACE) program. Neal stated this case is now before the California Supreme Court, with the potential to significantly impact the legal framework for property tax assessments and securitized loans in the state.
The publication also highlighted Neal's representation of Sterling Construction in a bet-the-company partnership dispute with Myers & Sons Construction L.P., in which Myers alleged that Sterling had failed to secure necessary bonding, leading to substantial financial losses. Neal noted that on the eve of the trial, both parties agreed to a settlement involving the sale of Sterling’s stake in the partnership for a structured payout.
Looking ahead, Neal Marder said that given the global nature of many legal disputes, litigators need to be aware of international laws and regulations. “The interconnectedness of the global economy and the rise of cross-border litigation add another layer of complexity, requiring litigators to have a broader and more nuanced understanding of international legal frameworks,” Neal concluded.
