ABA Journal Quotes Desireé Busching on Employer Vaccine Policies

Akin Gump labor and employment senior counsel Desireé Busching has been quoted in the ABA Journal article “Citing religion, health and even personal preference, some are challenging COVID-19 vaccine mandates at work.”
The article notes that employers may face challenges in implementing mandatory vaccine policies, such as complying with the Americans with Disabilities Act and Title VII of the Civil Rights Act, and those issues should be addressed as they seek to formulate those policies. Busching said, “The general recommendation is to find out how many employees are vaccinated and how many are not. That information helps employers decide if they want to implement a mandatory vaccine requirement.”
Busching added that mandatory vaccine policies may require additional administrative resources, which could be burdensome for some employers. Alternatively, she suggested that employers could consider making short-term “courtesy accommodations” available to those who prefer not to be vaccinated.
