In the article “Challenges Continue Regarding Expanding Diversity in The Boardroom and C-Suites,” written for the Harvard Law School Forum on Corporate Governance, partners Esther Lander and Richard Rabin and senior practice attorney Anastasia Kerdock discuss the resistance encountered by diversity, equity and inclusion (DEI) program initiatives in the workplace.
The article examines the ongoing challenges at the board and state levels faced by organizations driving these programs and initiatives and contrasts the situation in the U.S. with that in the EU and U.K., where, the authors write, there has not been “the same degree of activism challenging affirmative action as has occurred in the U.S.”
As the authors note in conclusion, “The DEI space is an evolving one, with many companies remaining committed to entrenching diversity, equity and inclusion in their corporate ethos. These efforts are not risk free, and we fully expect such efforts to remain subject to legal, public relations and other challenges as certain stakeholders continue to push back.”
