Akin Gump Arbitration 2020 Lecture Features Dr. Maxi Scherer on Law of the Arbitration Agreement

On November 25, the fifth installment of the Akin Gump Arbitration Lecture series was presented, with the participation of arbitration partner Hamish Lal and of litigation practice head Stephen Baldini who introduced a presentation by Professor Dr. Maxi Scherer titled “The Proper Law of the Arbitration Agreement: A Comparative Perspective.”
The purpose of the series, as noted by Baldini, is to “hear experts in the field of arbitration talk about important, topical issues that help to give a practical guide for issues facing practitioners and clients in the field.”
Dr. Scherer began her presentation by noting that the topic is sometimes seen as “a bit too academic. However, as we will see during the lecture today, it has very important practical ramifications when you draft the arbitration agreement as well as when you arbitrate or litigate an arbitration matter.”
She then used the decision of the U.K. Supreme Court in Enka v. Chubb as a jumping-off point for a discussion of the issues of the law governing the arbitration decision from broader and comparative perspectives.
