Law360 has published the article “In Cambodia, Criminal Defamation Law Is Broad,” written by Akin Gump’s Mark MacDougall, partner in the litigation practice, Rebekah Jones, counsel in the international trade practice, and Connor Mullin, associate in the litigation practice.
The article discusses a recent Cambodian court decision in which a British citizen living in Cambodia was convicted of defamation for statements published on his personal blog relating to the director of a private investment firm. Cambodian law, the authors write, permits an individual to be convicted of defamation “even if his statements do not result in actual damages, a necessary element of the civil cause of action in the United States.”
The developments in the case, the article notes, “will be significant for any individual or company doing business in Southeast Asia as Internet access and social media usage continue to surge in the region.”
