Akin Gump Author Tax Journal Article Comparing QAHC and UK Securitisation Regimes

Akin Gump partner Serena Lee and counsel Matthew Durward-Thomas have co-authored the article ‘QAHCs and UK securitisation companies: awkward bedfellows?’ which has been published by Tax Journal.
The qualifying asset holding company (QAHC) regime is shaping up to become a genuine competitor to Luxembourg and Irish holding companies. Previously, other than a normally taxed UK company, the main U.K. asset holding company options for loans and other financial products was a UK securitisation company, which gave rise to some practical difficulties when applied outside the context of a more traditional securitisation.
The published article discusses some practical changes of both regimes, and considers the current situation in which the U.K. is now left with two regimes that sit awkwardly beside (and slightly on top of) one another.
