Harvard Law School Forum on Corporate Governance has published the article “The SEC’s Latest Risk Alert Puts ESG Investing in the Crosshairs,” which discusses the Securities and Exchange Commission’s recent Risk Alert “highlighting staff observations from examinations of investment advisers, registered investment companies and private funds (firms) engaged in environmental, social, and governance (ESG) investing.”
The article, first published as an Akin Gump client alert, was authored by Akin Gump investment management partner Jason Daniel, corporate partner Cynthia Mabry, and environment and natural resources consultant Kenneth Markowitz, along with corporate senior practice attorney Cynthia Angell, corporate associate Leana Garipova, and environment and natural resources associate Bryan Williamson. They examine the areas in which SEC staff have focused their examinations of firms engaged in ESG investing, the deficiencies the staff have observed as well as effective practices they have seen.
