The article, which originated as an Akin Gump client alert, discusses President Trump’s invocation of the Defense Production Act (DPA) and what it means for the “allocation of materials, services and facilities from any company or person in the U.S.”
Following Mr. Trump’s executive order invoking the DPA, which gives him “broad authority to prioritize and allocate health resources,” the authors note that the Health and Human Services Secretary will be required to develop “a specific plan” for allocation that includes items such as, a statement of the specific objective(s) of the allocation action; a list of the materials, services or facilities to be allocated; and a detailed description of the provisions that will be included in the allocation orders.
