Akin Gump Litigators Discuss False Claims Act Case in Financial Fraud Law Report Article

Several members of Akin Gump’s litigation practice have authored an article for Financial Fraud Law Report on a 2013 federal False Claims Act case in which they obtained a significant victory on summary judgment.

Edward Woods and Susan Leader, partners at Akin Gump, along with Amjad Khan and Kelsey Morris, counsel and associate, respectively, write that United States ex rel. Humane Society v. Westland/Hallmark Meat Company et al. was the first time in the Ninth Circuit “a court has required the government to establish more than just an “attenuated link” between a third party defendant’s actions and the submission of the alleged false statement or claim.”

The case was heard in the Central District of California, with the authors noting “it remains to be seen what causation standard the Ninth Circuit will ultimately adopt.”
