Law360 has published an article, "Deficiency Trends in National Futures Association Exams” co-authored by Akin investment management partners Brian Daly and Jan-Paul Bruynes. The article analyses the deficiency trends outlined in the notice issued by the National Futures Association on February 12th and proposes practical considerations for NFA members moving forward.    

One of the most frequent deficiencies highlighted was NFA members using outsourced third parties to complete regulatory functions on their behalf.  Daly and Bruynes advise that NFA member should implement and have in place, “robust procedures governing the use of outsourced service providers that preform regulatory functions” to, “head off possible deficiencies in an area that is sure to remain a priority in NFA exams in the coming years.”
