For its article “FCC Data Breach Rule Updates for Carriers Add to Regulatory Maze,” Bloomberg Law quoted Akin telecom, media & technology partner Steven Rowings. The article discusses the Federal Communication Commission’s (FCC) data breach reporting rule updates for telecommunications carriers.

The article notes that as the FCC expands its reporting obligations for carriers, companies will need to reassess their breach notification processes. “Companies are going to have to come up with significantly more comprehensive monitoring and tracking processes and controls,” Steve said.

The FCC’s rules on privacy expansion are facing political criticism, with some expressing concerns about potential conflicts with a Congressional Review Act (CRA), according to the article. It remains uncertain if the industry will challenge the rules legally, but, Steve said, it is not ruled out.

Steve further noted that there is “not a lot of case law” regarding whether a CRA violation can be brought up for judicial review.
