CCBJ Publishes Akin Gump Article on Federal Protections for Those Helping with COVID-19 Response

Corporate Counsel Business Journal has published the article “Federal Protections Against Liability for Businesses Combatting COVID-19,” written by Akin Gump litigation partner Anthony Pierce, senior counsel Caroline Wolverton and associate Sina Kimiagar. Originating as an Akin Gump client alert, the article outlines some of the recent steps taken to protect businesses and individuals “who are part of the nation’s response to the current public health emergency.”
Among the measures that have been implemented are the Public Readiness and Emergency Preparedness Act, which “provides limited immunity for businesses and individuals that develop, test, manufacture, distribute, administer, prescribe or use “covered countermeasures” in combatting a public health emergency.” The authors also discuss the Defense Production Act, antitrust immunity and CARES Act immunity for health care professionals who volunteer to help.
The article concludes “by recognizing the possibility of additional protections as the federal and state governments continue to address to the public health crisis.”
