CDR Quotes Justin Williams on Environmental Litigation and Parent Company Liability

For the article “Environmental Litigation Heats Up,” Commercial Dispute Resolution (CDR) quoted Akin Gump international arbitration practice head Justin Williams. The article discusses how governments and corporates are facing a rise of environmental lawsuits launched by individuals, NGOs, companies and trade associations over climate change, environmental damage and allegations of ‘greenwashing’.

With both corporate challenges and cross-border actions on the rise, Williams notes that this may have huge consequences for the liability of parent companies for the actions of their subsidiaries, “a series of recent UK Supreme Court decisions has highlighted the increased exposure of UK parent companies to tort claims by parties affected by the activates of their subsidiaries.” Williams continues that “this is not ‘piercing the corporate veil’ but arises from a direct duty of care owed by parent entities to third parties.”
