Akin Gump global project finance partner Dan Lynch was quoted by Law360 for its article “How Texas Energy Work Has Changed 1 Year After Uri,” regarding the winter storm that caused blackouts across the state and roiled Texas’ electricity markets in 2021.

On the topic of fixed-shape hedges, which involve parties contracting for power to be sold in specific amounts, at a specific time, at specific prices, the publication notes these are a “no-go in Texas.”

Lynch, whose practice includes a focus on energy marketing and trading, concurs: “My impression is that no one is touching it with a 10-foot pole now in ERCOT [Electric Reliability Council of Texas].”
