Energy Law Report Publishes Akin Gump Article on DOJ’s New Environmental Enforcement Stance

Energy Law Report has published the article “Justice Department Sets Stage for More Aggressive Environmental Enforcement,” co-authored by Akin Gump environment and natural resources head David Quigley, fellow partner Stacey Mitchell, consultant Kenneth Markowitz, and associates Jack Lyman and Bryan Williamson.

Adapted from an Akin Gump client alert, the article discusses a move by the Justice Department to withdraw several Trump-era environmental law policy and guidance documents. The authors write that the withdrawn policies “contributed to a dramatic decrease in environmental enforcement” during the last administration.

The article also looks at potential areas of greater enforcement in the Biden-Harris administration, including with regard to the Clean Air Act. The authors suggest that regulated entities should ensure that their facilities “have a robust and up-to-date environmental audit system in place and that employees and managers are current on environmental monitoring and reporting training.”
