Gary McLaughlin Quoted by SHRM on Push Toward Predictable-Scheduling Laws

SHRM has quoted Akin Gump labor and employment partner Gary McLaughlin in the article “Predictable-Scheduling Laws May Impact More California Businesses.” The article reports on a move under way in the Golden State toward legislation requiring that employees receive advance notice of their schedules or collect premiums for disruptive, last-minute changes or shift cancellations.
According to SHRM, the measures target the practice of on-call scheduling, when workers are expected to show up for work on short notice and may have scheduled shifts canceled without compensation. Predictable-scheduling laws are already in effect in Seattle and New York City, with several other municipalities and states considering similar actions.
McLaughlin said he thinks Los Angeles will likely enact workweek legislation. He also expects large businesses operating statewide, even those that operate in municipalities without on-call scheduling laws, to adopt predictable-scheduling regulations. Without it, those businesses, he said, will struggle to comply with a patchwork of similar—but not identical—laws.
“The challenge now for HR professionals is keeping up with what’s going on," McLaughlin said. “It’s easy to lose track of local ordinances.”
