HazMat Management Publishes Akin Gump Article on EPA Delay of Risk Management Plant Requirements

HazMat Management Magazine has published the article “U.S. EPA Delays Risk Management Plant Requirements for Chemical Plants and Refineries,” written by Akin Gump senior counsel Charles Franklin and partners Stacey Mitchell and David Quigley, all members of the firm’s environment and natural resources practice.

The article, which originated as a blog post on the AG Speaking Energy blog, examines an announcement last month by Environmental Protection Agency Administrator Scott Pruitt of another extension to the effective date “of the Obama-era rule amending federal Risk Management Program (RMP) requirements for chemical facilities, oil refineries and other industries.” This now pushes the effective date to February 2019 to allow time for reconsideration of the rule and provide additional comment opportunities.

The authors write that the final amendments, issued in January, just a week before President Trump took office, would impose “additional public notice, reporting, accident prevention and emergency response planning obligations on facilities that use or store certain high-risk substances, depending on the nature and risk of the facility’s operations.”

Franklin, Mitchell and Quigley add that the EPA has said it will use the additional time “to review and consider questions and concerns raised in multiple petitions for reconsideration and other comments received during the public comment period and public hearing.”
