Hedge Fund Law Report Publishes Article Based on Akin Gump SEC ESG Proposal Webinar

Hedge Fund Law Report has published “A Roadmap to Proposed ESG Disclosures on Form ADV,” an article drawn from presentations by investment management partner Brian Daly, white collar defense and government investigations partner Katherine Goldstein, and ESG and climate change groups co-leader Stacey Mitchell at Akin Gump’s “The SEC’s ESG Proposal: The Private Fund Manager Impact” webinar.
The article looks at topics such as the Biden-Harris administration’s focus “since day one” on environmental, social and governance (ESG) issues, particularly the fact that “the SEC has been signaling for some time that it wants to be active in enforcement in the ESG space.”
The article also covers the Securities and Exchange Commission’s (SEC) April 2021 ESG risk alert and its May 2022 proposal for enhanced disclosure rules for certain advisers and registered investment companies, noting that the proposal feels “like two rules jammed together,” with some parts addressing registered funds, and others focusing on private fund and other investment advisers.
