IFLR Publishes Akin Gump Article on New UK Foreign Direct Investment Bill

IFLR has published the article “The UK FDI regime compared,” written by Akin Gump partners Jasper Helder and Davina Garrod and counsel Daniel Lund. The article looks at how the United Kingdom’s proposed national security and investment review proposals align with those already in place in other countries.
The authors write that the new National Security and Investment (NSI) Bill “will see the U.K. introduce one of the most comprehensive and detailed investment screening mechanisms globally.” While it contains “many of the legislative controls adopted in overseas regimes,” they note that it also introduces “several new, untested, features.”
The article then outlines some of the different aspects of the Bill, which the authors say “will be the subject of intense cross-party discussions as it makes its way through Parliament.” Once in place, which they expect to be near the middle of 2021, they write that the legislation “is likely to affect a wide range of investment activity and could impact a range of corporates and funds that count foreign nationals and foreign governmental entities among their investors.”
