LexisPSL has published the article “Malaysian Airlines—English Scheme of Arrangement sanctioned (Re MAB Leasing),” written by Akin Gump financial restructuring partner Lois Deasey and counsel Emma Butler.

The article provides analysis of a ruling by the High Court of England and Wales, which sanctioned a scheme of arrangement between Malaysia’s MAB Leasing Ltd and certain of its creditors.

In his judgment, Deasey and Butler write, Mr. Justice Snowden “considered the ability of a foreign company to propose an English scheme, questions relating to the Cape Town Convention on International Interests in Mobile Equipment (the CTC) and associated Protocol to the CTC on matters specific to Aircraft Equipment (the Aircraft Protocol).” The authors add that the court also looked at whether it could sanction a scheme “proposed with unanimous scheme creditor support.”
