Inside EPA Quotes Matt Nicely on Biden Solar Panel Tariff Decision

For its article “Biden Energy Moves Seen As Possible Precedent For Climate Emergency,” Inside EPA’s Climate Extra quoted Akin Gump international trade partner Matt Nicely.

The article discusses the Biden-Harris administration’s two-year bar on solar panel tariffs and its use of defense authority to expedite low-carbon options such as heat pumps.

The article quotes Solar Energy Industries Association’s (SEIA) president and Nicely from a June 7 SEIA webinar. [Note: SEIA is a client of Akin Gump.]

Referencing the Tariff Act of 1930, which the administration is using for its solar tariff freeze, Nicely said, “We think that the statute provides perfectly sufficient authority for the President to do what he did.” He did, however, acknowledge that the Department of Commerce will need to issue a regulation implementing the President’s action and perhaps offer a brief notice and comment period.
