Kevin Wolf Quoted by Nikkei Asian Review on Exception to Restrictions on US Tech Exports to China

In its article “US chip startup exploits trade war to expand in China,” Nikkei Asian Review quoted Akin Gump international trade partner Kevin Wolf on an exception to restrictions imposed by the Trump administration on export of U.S. technology to China.

The article discusses the possible use by a U.S. startup company of the open source RISC-V chip architecture to design chips that could be sold to Chinese clients.

Regarding the breadth of the restrictions, shown by the Commerce Department placing Huawei Technologies and five more Chinese companies on its Entity List, Wolf, a former Assistant Secretary of Commerce for Export Administration, noted that the restrictions do not apply to open source technology.

Wolf said, “Technology that is ‘published’ and openly accessible is not subject to the Export Administration Regulations and thus not affected by Entity List prohibitions.”
