Following the World Trade Organization’s 13thMinisterial Conference that ended March 2, 2024, one of the issues that requires engagement ahead of the next ministerial gathering in 2026 are the rules governing electronic commerce.

For many years, a single rule has shaped the landscape – the e-commerce moratorium, a WTO agreement not to impose any taxes on cross-border electronic commerce. The rule has been getting increasingly hard to extend due to opposition from some developed economies.

Jan, Hannes and Kulsum consider the steps being taken towards new global rules on e-commerce, what an alternative to the e-commerce moratorium could look like and the challenges that lie ahead in negotiations.
