Law360 has published the article “Overlooked PTAB Cases: Raising Nonobviousness Evidence,” written by Akin Gump intellectual property partner Rubén Muñoz and counsel Jonathan Underwood and Caitlin Olwell. The article, part of an ongoing series by Akin Gump’s IP team, looks at how the Patent Trial and Appeal Board (PTAB) “has dealt with objective evidence of nonobviousness in deciding whether to institute inter partes review (IPR) and the implications for parties involved in IPR proceedings.”
By examining recent PTAB decision, the authors discover “when a petitioner must address this evidence in a petition and, conversely, when a patent owner should raise the evidence in a preliminary response.”
