A client alert authored by Akin Gump antitrust partners Paul Hewitt and Fairley Spillman and associate Diana Gillis, “Bosley Information Exchange Case Is A Cautionary Tale,” was published by Law360. The alert discusses a recent Federal Trade Commission suit over exchange of sensitive business information by competitor companies.

The case, settled on April 8, involved allegations that Bosley Inc. and its parent companies had illegally exchanged sensitive pricing and other information with one of its competitors, Hair Club for Men and Women.

The article states, “The FTC sued using its ‘unfair methods’ authority under Section 5 of the FTC Act, even though the conduct may not have violated the Sherman Act. The fact that the challenged information exchanges involved CEOs of the respective companies underscores the need to include all high-level executives in company antitrust compliance programs.”
