Law360 Publishes Akin Gump Review of Native American Successes in Recent Supreme Court Term

Law360 has published the article “A Successful US Supreme Court Term For Native Americans,” written by Akin Gump partners Pratik Shah, who co-heads the firm’s Supreme Court and appellate practice, James Tysse, Donald Pongrace, head of the public law and policy practice, and Michael Rossetti.

The article discusses the cases heard by the Supreme Court during what is described as “an unusually active term for Native American law issues.” There were three major cases heard, the authors write, with two of them decided unanimously in favor of tribal interests. A third was deadlocked at 4-4, “which involved the scope of tribal court civil jurisdiction over nonmembers” preserving the 5th Circuit’s jurisdictional ruling in favor of the tribe.

In addition to providing details on the major rulings from the past term, the authors also outline the issues at stake in two cases with pending certiorari petitions.
