Law360 Publishes Hanson, Gregory Article on WA Anti-Rebate Laws

“Washington State Should Amend Its Anti-Rebate Laws,” an analysis and opinion piece by Akin Gump litigation partner Shawn Hanson and counsel Nicholas Gregory, has been published by Law360.
The article looks at the recent series of decisions in a case involving insurance broker Zenefits and Washington state’s Office of the Insurance Commissioner (OIC) and discusses anti-rebate laws, in general, and the Washington case, specifically.
That case hinges on the fact that Zenefits was giving away its software to the state’s consumers. The back and forth following the OIC’s order to Zenefits to cease doing so yielded a challenge by Zenefits, an administrative law judge’s decision supporting the company and an administrative reviewing officer’s reversal of that decision.
The result is that state residents have ended up paying for something that would otherwise be free.
Hanson and Gregory opine that “because there is no policy justification for applying the state’s anti-rebate laws to gifts to the general public, Washington should follow Utah’s lead and amend its laws.”
