“What's Causing EU-US Impasse On Steel And Aluminum,” an article by Akin international trade partner Bernd Janzen, counsel Sarah Sprinkle and associate Hannes Sigurgeirsson, has been published by Law360.
The article looks at the negotiations for a Global Arrangement on Sustainable Steel and Aluminum (GASSA) launched in 2021 by the United States and European Union. GASSA, the authors write, “would link import restraints to exporting countries' efforts to reduce carbon intensity in metals production and global overcapacity in the aluminum and steel industries.”
Both sides agreed to suspend additional tariffs on steel and aluminum imports during negotiations, with an October 2023 deadline when U.S. tariffs could resume.
The authors note that negotiators must still “overcome high obstacles to success” such as U.S. demands that its aluminum and steel products be excluded from the EU’s planned carbon borer adjustment mechanism.
They outline the road to the October 2021 negotiations, both sides’ goals, and the state of the negotiations, including the current impasse.
