Christian Davis, counsel in the international trade practice at Akin Gump, has been quoted in POLITICO’s Morning Trade and in the Law360 article “3 Takeaways From Trump’s Block Of China Chipmaker Deal,” discussing President Trump’s recent decision to block the purchase of a U.S. semiconductor company by a Chinese venture capital firm.
Davis said President Trump’s decision to support the recommendation by the Committee on Foreign Investment in the United States (CFIUS) signals that he will listen to the recommendations of his administration on cases involving CFIUS and not go off on his own.
Davis told POLITICO that in future deals, “investors may be more likely to abandon a transaction in similar circumstances and less inclined to challenge CFIUS’s recommendation by forcing a formal decision from the president.”
Davis added to Law360, “What I think is noteworthy here is this is first time during the Trump administration that parties have said, ‘Okay, send this on to the president, we think the president will do something different than your recommendation,’ and they rolled the dice to see what the president was going to do.”
