Meng Ru Quoted on China’s Legal System

Akin Gump corporate partner Meng Ru was quoted by Super Lawyers for its article “Navigating China,” which discusses the growth of that country’s legal system in the latter part of the 20th century as well as offers notes on what to know regarding topics such as discovery, language differences and business culture in order to work most effectively in China.
Regarding the development of China’s legal system, Ru said, “Earlier on, the German and the Japan systems had a big influence on the Chinese system. We were all statutory-based. Now, in the commercial sector, securities law, those things, I think the U.S. and U.K. system have a significant influence on the Chinese system.”
Regarding what the article characterizes as the irony of foreign lawyers who helped China draft and develop its laws in the ‘70s and ‘80s not being allowed to practice law there, she said, “Foreign law firms cannot give Chinese legal opinion. So therefore, as a fresh graduate back then [working for O’Melveny & Myers in Shanghai], I was not eligible to receive a Chinese lawyer’s license. For practicing Chinese lawyers, they have to give up their license to join a non-Chinese law firm.”
