Metropolitan Corporate Counsel Interviews John Holton on New Investment Opportunities in India

Metropolitan Corporate Counsel has featured Akin Gump investment funds partner John Holton in the article “Investors See Changes – and Opportunities.” Holton, who advises clients on emerging markets in Asia, discusses, among other topics, registration requirements for non-U.S. fund managers and India’s booming economy.

Holton first talked about some of the most daunting challenges that emerging market funds face. He noted that getting prospective investors comfortable with the risks associated with emerging markets is a big necessity, but added that the emerging economies “offer the prospect of strong and steady growth over the next 20 or 30 years. For investors who have a long time horizon, growth over that extended period of time is extremely valuable.”

With regard to registration requirements for fund managers based outside the United States, Holton said those individuals rely on “what’s known as the private fund adviser exemption” with a reduced reporting burden under the U.S. Investment Advisers Act.

On the topic of India, Holton said three very important steps have been taken recently: the reform of the bankruptcy laws, currency reform and the imposition of a new nationwide sales tax. He also said the government’s new infrastructure initiative offers “many investment opportunities” that are a “win-win” for investors.
