National Law Journal Publishes Prober and Christian Article on Expectations for Congressional Investigations in New Congress

Rafi Prober and Karen Christian, partners in the congressional investigations practice at Akin Gump, have authored “Under Investigation: Who Will Fall in the New Congress’ Crosshairs?” for The National Law Journal. The article looks at what corporate America can expect in the way of congressional investigations, given the changing political landscape in Washington.
Prober and Christian write that, while the Democratic-controlled House of Representatives has spent the past two years investigating the Trump administration, “It is important for companies to consider now whether their business activities might draw the interest of congressional investigators over the next two years, and to prepare accordingly.” Democrats, the authors note, should be expected to “shift their oversight agenda toward the industries and issues that align with their legislative platform.”
The article then outlines which particular topics appear to be likely targets for congressional investigations with Democrats holding the majority in the House. As a result, the authors say, “Companies would be well-served to understand the president-elect’s and the Congress’ policy and oversight goals, and prepare for possible questions and document demands now, before subpoenas start flying.”
