New York Law Journal Publishes “Tapping Insurance Proceeds in Class Actions” by David Zensky and Nicholas Adams

In its Insurance law special section, New York Law Journal has published the article “Tapping Insurance Proceeds in Class Actions,” written by David Zensky and Nicholas Adams, partner and counsel, respectively, in the litigation practice at Akin Gump.

The article examines the use of assignments in complex class action lawsuits where an individual defendant does not wish to contribute personal funds or is judgment proof. The authors, using In re Platinum and Palladium Commodities Litigation as a case study, note that “no amount of advance planning can ensure an unimpeded settlement approval where third-party stakeholders are vying for the same pool of insurance proceeds.”
