Privacy & Cybersecurity Law Report has published the article “CCPA: Impacts and Significance for Business,” a Q&A with Natasha Kohne and Michelle Reed, co-heads of Akin Gump’s cybersecurity, privacy and data protection practice, about the California Consumer Privacy Act (CCPA), its significance on the state and federal levels, and some of the key issues and implications raised by the law.
The article, which originated as an OnAir with Akin Gump podcast (click here to listen), begins with some background on the CCPA and why it is considered significant as a bellwether for state-level and federal privacy legislation. Reed notes that the CCPA “is the first comprehensive privacy law enacted in the United States.” Previously, she said, the only privacy laws were “generally sectoral.” Kohne added that the CCPA “was a catalyst for producing state legislation across the country” with more than half the states now having introduced their own similar legislation.
The article then looks at how the CCPA compares from a business perspective with other state-level privacy legislation and whether other states are copying the CCPA in their own legislation. It also addresses the issue of attorney-client privilege and the main CCPA-related issues that are being raised by the plaintiffs’ bar.
Finally, the conversation turns to the California attorney general’s revised proposed regulations regarding the CCPA that were recently released as well as some steps one can take to ensure compliance with the law.
