Ryan Fayhee Quoted by Anti-Corruption Report on the DOJ’s Plans to Launch Whistleblower Program

Anti-Corruption Report has quoted Akin international trade partner Ryan Fayhee in its article “The DOJ Announces Intention to Launch Whistleblower Program: What Will It Look Like?” The article discusses the Department of Justice’s (DOJ) plans to launch a new whistleblower program this year to encourage voluntary self-disclosure by companies to increase the likelihood of the DOJ uncovering violations first.
Ryan said that because the program relies on existing statutory powers, there will be no need for congressional approval or additional budget – the DOJ or law enforcement agencies could use those forfeited funds without seeking new funding from Congress.
The article also discusses the Money Laundering and Asset Recovery Section’s (MLARS) role in designing this program. Ryan said “MLARS is supposed to be the Department lead of managed forfeiture statutes. It is the natural place.”
In closing, Ryan noted that the DOJ will need to build a process surrounding how to manage whistleblower leads. The Department will need “a dedicated office to ensure that whistleblowers are treated fairly and ultimately receive an award of some type.”
