Law360, for its article “Consumer Protection Cases To Watch In 2019,” quoted Akin Gump litigation partner Seamus Duffy on a matter before the Federal Communications Commission (FCC) involving the Telephone Consumer Protection Act (TCPA).

In March 2018, the D.C. Circuit ruled that the FCC had overreached in expanding the TCPA’s scope through overbroad definitions of certain terms. The Commission is expected to issue a decision in response.

Duffy said that, as the TCPA has spawned significant consumer litigation against companies, “We anticipate and are hopeful that they’ll bring some real sanity to the TCPA.”
