“Justice Louis Powell and the Evolution of Modern Securities Law: A Review of a History of Securities Law in the Supreme Court by A. C. Pritchard and Robert B. Thompson,” written by Akin investment management partner James Deeken, has been published by Securities Regulation Law Journal.
In his review of this history, which he calls “an in-depth and well researched study of the history of the Supreme Court’s securities law jurisprudence,” James offers an outline of securities law at the Supreme Court beginning after the Great Depression. He notes the appointment of Louis Powell to the Court as helping to “alter the course of the Court in its formerly deferential views of the securities laws” and discusses the impact of Justice Powell, spotlighting several key instances in which he authored “key securities law cases with narrow majorities that continue to have implications today.”
