Akin Gump Advises Nursing Home in Fifth Circuit False Claims Act Win

(Washington, D.C.) – An Akin Gump team won in a qui tam False Claims Act suit on behalf of client GGNSC Southaven LLC at the U.S. Court of Appeals for the Fifth Circuit.
The purported whistleblower in this case sought $30 million in a suit that accused the firm’s client, a nursing home in Tylertown, MS, of knowingly employing a nursing director who was not licensed or lawfully authorized to practice in Mississippi. A district court judge, in March, held that the purported whistleblower had failed to establish that false claims were submitted.
The Fifth Circuit affirmed that lower court finding of summary judgment in favor of the nursing home, noting in its ruling that GGNSC’s actions while the nurse worked with it “fully comported” with Centers for Medicare and Medicaid Services guidance.
