Akin Gump Defeats Putative Class Action Against VCA, Inc.

(Los Angeles) – Akin Gump achieved complete dismissal of a putative nationwide class action, Graham v. VCA Inc., in the U.S. District Court for the Central District of California against VCA, Inc. and VCA Animal Hospitals, Inc.
Two pet owners who are former VCA clients had filed a class action lawsuit against VCA alleging it violated both California’s and Oklahoma’s consumer laws by charging them and most VCA clients a biohazard waste management fee that was included as a line item on their invoices. The court, in granting VCA’s motion for summary judgment in full, dismissed all of the plaintiffs’ claims, and denied their motion for class certification as moot. The court rejected every argument that plaintiffs made in opposition to VCA’s summary judgment motion.
