Akin Gump Hosts CLE Program on Resolving Government Investigations of Energy Companies

(Houston) – Akin Gump hosted a CLE program today, titled “Pathways to Successfully Resolving Government Investigations of Energy (and Other) Companies,” which looked at some best practices in handling government investigations.
Chris LaFollette, partner in charge of Akin Gump’s Houston office, moderated the discussion. She was joined by David Applebaum, a partner and co-head of the firm’s energy regulation, markets & enforcement practice; Stacey Mitchell, a partner in the environment and natural resources practice; and Peter Altman, a partner in the white collar defense and government investigations practice.
The program offered practical guidance to energy and other companies on the best ways to:
- Engage with a government agency conducting an investigation
- Manage the attorney-client and work product privileges to best protect internal communications and any advice of counsel defense
- Evaluate the need for disclosure of the investigation
- Watch out for rules on whistleblower protections
All three panelists previously held positions in the federal government, including at the Department of Justice and Environmental Protection Agency (Ms. Mitchell), Securities & Exchange Commission (Mr. Altman), and Federal Energy Regulatory Commission (Mr. Applebaum).
