(Washington, D.C.) – Today, the U.S. International Trade Commission’s (ITC) issued a determination that U.S. imports of Fresh, Chilled, or Frozen Blueberries are not a substantial cause of serious injury, or threat of serious injury, to the domestic blueberries industry. As such, the ITC declined to recommend to the President that any restrictions be placed on blueberry imports into the country. The decision represents a victory for the Blueberry Coalition for Progress and Health, a broad cross-section of the U.S. blueberry industry formed to oppose limitations on blueberry imports.
A team of Akin Gump lawyers represented the Blueberry Coalition, leading the defense before the ITC. Partner Matthew Nicely, who led the Akin Gump team, commented, “We are pleased with the ITC’s determination in this case. Thanks to a strong factual record and key assistance from our economic consultants, we were able to prove that the U.S. blueberry industry is thriving, and that restricting imports would have only harmed consumers and provided no benefit to the domestic industry.”

In addition to Mr. Nicely, the Akin Gump team representing the Blueberry Coalition included counsel Julia Eppard and associates Sydney Stringer and Paul Bettencourt. Also supporting the effort were Brian Pomper, Stephen Kho, Yujin McNamara, Sarah Kirwin and Atsushi Oshima.
