SB 1291: Idaho Prohibits Public Contracting with Companies that Boycott Fossil Fuel or Firearms Industries

Summary

SB 1291 was enacted in March 2024 and became effective on July 1, 2024. It prohibits public entities from contracting with a company for goods or services unless the company certifies in writing that it does not and will not boycott an individual or company based on their engagement in or support of fossil fuel-based energy, timber, minerals, hydroelectric power, nuclear energy, or agricultural industries or engagement in or support of the firearms industry. 

"Boycott" is defined to mean, "without a reasonable business purpose," refusing to deal with, terminating business with, or taking other action intended to economically harm relations with an individual or organization because they engage in the particular business sectors. A "reasonable business purpose" under the law means one that is directly related to promoting the company's financial success, mitigating risk, complying with the law and regulations, or limiting the company's liability.
