SB 97: Utah Prohibits Contracts with Companies that Boycott the Fossil Fuel, Firearms, and Other Industries

Summary

Enacted in March 2023, SB 97 prohibits public entities from entering into a contract with a company that engages in boycotts of certain activities or industries, including fossil fuel-based energy, mining, timber, and agricultural production; firearms; environmental standards; and access to abortion or sex characteristic surgical procedures. The law builds on a 2021 law, SB 186, which prohibits state entities from contracting with companies that boycott, or refuse to do business with, Israel.

It requires public contracts to include a provision certifying that "the company is not currently engaged in a boycott of the State of Israel; or an economic boycott." The law exempts contracts with a total value under $100,00 and contracts with companies that have fewer than 10 full-time employees.
