Biography
  • Health care and life sciences regulatory compliance practice with significant expertise on privacy and cybersecurity in mergers and acquisitions (M&A) transactions.
  • Advises on tech, privacy and cybersecurity-related compliance, investigations and enforcement actions.

Daniel is counsel in Akin’s health care and life sciences practice. Daniel practices at the intersection of health regulatory, legislative and transactional matters. What Akin does best is pair its A-list public law & policy practice with a top-flight legal team, and Daniel’s practice pivots at that intersection.

Daniel has extensive experience working across the regulatory compliance and corporate space, from representing multibillion-dollar companies before the United States government, to advising on multimillion- and multibillion-dollar transactions across the health regulatory, privacy, technology and cybersecurity space.

Daniel received his J.D. from The University of Texas School of Law where he was an associate editor for the Texas Law Review.

Prior to law school, Daniel served as a Legislative Assistant for Congresswoman Gabrielle Giffords (D-AZ). He also has three cycles of federal campaign experience managing teams in Arizona and California.

Daniel is a member of the Pro Bono Committee, the firm’s Always Green Council, the American Health Lawyers Association, the International Association of Privacy Professionals and a Life Member of the Texas Exes.

Representative Work

Health Policy & Regulation

  • Represented the American Medical Association in its Administrative Procedure Act (APA) litigation against the U.S. government challenging the implementation of the No Surprises Act.
  • Represented the sole supplier of Penicillin G to U.S. hospitals in resolving a global supply-chain issue, restarting operations to avoid potential drug shortages in the U.S.
  • Represented the largest air and ground ambulance company in the U.S. Congress and in meetings with the administration in support of a system to protect patients from surprise bills while protecting access to care in rural America by implementing a fair, market-based dispute resolution process with payors.
  • Advised the largest independent ambulatory surgery center company on operations during the COVID-19 shutdown, hospitals without walls, the Paycheck Protection Program and the CARES Act implementation.

Cybersecurity, Privacy and Data Protection M&A and Regulatory Compliance

  • Advised as privacy and cybersecurity specialist on over 40 M&A transactions in 2021 in the health care, tech, consumer retail and general commercial space.
  • Advised on data breach response, notice and mitigation efforts for global investment manager.

Health Care Transactions

  • Health regulatory and privacy counsel on $5.6 billion acquisition of LifePoint Health, a 79-hospital chain by RCCH Healthcare Partners.
  • Health regulatory and privacy counsel on first hospital acquisition by Apollo Global Management (RegionalCare Hospital Partners), and follow on acquisition of Capella Healthcare, Inc., forming 16 hospital systems across 12 states with $1.7 billion in revenues.
  • Health regulatory counsel on acquisition of AI-driven, genomics-based precision medicine telemedicine company.
  • Health regulatory and privacy counsel on acquisition of innovative bundled care payment finance company.
  • Health regulatory and privacy counsel on acquisition of telehealth neuromonitoring company.

FDA Regulatory Compliance

  • Represented global antibiotics manufacturer in discussions with the U.S. Food and Drug Administration (FDA) around onshoring the supply chain for essential medicines and the President’s 100-Day Report on securing America’s supply chains.
  • Successfully represented medical device manufacturer challenging dispositive draft guidance for industry.
