David Staber focuses his practice on bankruptcy law, including representation of trustees, committees, debtors, creditors, litigants, and potential purchasers of assets or companies. He regularly advises on deal structure, risks of insolvency proceedings, and bankruptcy alternatives and solutions.
David appears on behalf of his clients in courts throughout the United States. Clients increasingly rely upon his experience as fluctuating oil and gas markets continue to create distressed investment opportunities.
- Counsel to Curo Group Holdings, a leading consumer credit lender serving the U.S. and Canada, in its chapter 11 cases involving over $2.1 billion of debt.
- Counsel to International Shipholding Corporation (ISH) and its affiliates, a shipping company, in its chapter 11 cases involving $227 million in liabilities.
- Counsel to Loyalty Ventures and its affiliates, an operator of customer loyalty programs, in their chapter 11 cases involving over $656 million in liabilities.
- Counsel to the Joint Official Liquidators of Security Capital as they sought to enforce claims in the face of the Internal Revenue Service (IRS) and the Securities and Exchange Commission (SEC) opposition to payments to foreign companies in liquidation, reaching a successful global settlement.
- Counsel to an energy company in its acquisition of a sand mining company's assets out of bankruptcy, formulating a bid and creating an innovative structure in order to prevail at auction.
