Biography
Licensed to practice in New York only and under the direct supervision of a partner of Akin Gump Strauss Hauer & Feld LLP who is an enrolled, active member of the District of Columbia Bar; applicant for admission to the D.C. Bar.
  • Advises companies and individuals in connection with government investigations and related enforcement proceedings, litigation, compliance counseling and other strategic risk analysis and mitigation.
  • Significant experience in matters before the SEC, FinCEN, FDIC and numerous international law enforcement and regulatory agencies.
  • Served in the FCPA Unit of the DOJ Criminal Division’s Fraud Section for over eight years, most recently as an Assistant Chief.

Gerry Moody represents public and private companies and their key individuals in white collar criminal and regulatory defense matters, including in government investigations and enforcement proceedings, internal investigations and civil litigation.

Prior to joining Akin, Gerry served for over eight years—including three and a half as an Assistant Chief—in the Foreign Corrupt Practices Act (FCPA) Unit of the U.S. Department of Justice (DOJ) Criminal Division’s Fraud Section. As an Assistant Chief, Gerry supervised over 75 matters involving FCPA, money laundering, securities fraud, wire fraud, sanctions violations, tax evasion and other corruption-related offenses; directly supervised more than 15 federal prosecutors; and oversaw multiple corporate FCPA resolutions and charges against individuals. As a trial attorney in the unit, Gerry served as the lead prosecutor in over 50 investigations, resulting in seven corporate FCPA resolutions involving over $1.5 billion in coordinated global penalties; charged 15 individuals with FCPA and related offenses; and tried four jury trials to verdict against defendants charged with offenses related to foreign bribery, securities fraud and health care fraud—all of which resulted in convictions. During his tenure, Gerry assumed a lead role on some of the Fraud Section’s most significant matters, including the cross-border investigation and prosecution of two prominent financial services firms, resulting in global penalties of more than $1 billion. For his work on this case, Gerry received the Attorney General’s Award for Distinguished Service.

Gerry has extensive experience working closely with the U.S. Securities and Exchange Commission (SEC), the Financial Crimes Enforcement Network (FinCEN), the Federal Deposit Insurance Corporation (FDIC) and a variety of international law enforcement and regulatory agencies, including the United Kingdom’s Serious Fraud Office, Brazil’s Ministério Público Federal and Office of the Comptroller General, Switzerland’s Office of the Attorney General and France’s Parquet National Financier, among others.

Gerry draws upon his deep knowledge of the inner workings of U.S. and international enforcement authorities—and a thorough understanding of how these authorities evaluate and approach cases—to advise and defend clients facing regulatory and criminal investigations, enforcement proceedings and civil litigation involving:

  • Foreign Corrupt Practices Act (FCPA)
  • Anti-money laundering (AML) statutes
  • Bank Secrecy Act (BSA)
  • Public corruption
  • Wire and mail fraud
  • Sanctions regimes.

Prior to his tenure at the DOJ, Gerry spent six years as an associate specializing in white collar defense and securities litigation matters at a leading international law firm and clerked for Judge Roslynn R. Mauskopf in the U.S. District Court for the Eastern District of New York. Gerry received his J.D. with honors from Columbia Law School, where he served as Notes Editor for the Columbia Business Law Review.

Representative Work
  • Led the investigation and prosecution of two prominent multinational financial services firms, resulting in a parent-level deferred prosecution agreement, subsidiary-level guilty plea, the first-ever coordinated resolution of a foreign bribery case with France’s Parquet National Financier and global penalties of more than $1 billion.
  • Led the investigation and prosecution of a foreign insurance company, resulting in an FCPA Corporate Enforcement Policy declination for the company and foreign bribery-related money laundering charges against a former government minister, as well as the Chief Executive Officer and a Senior Vice President of the company. Convicted the former government minister of foreign bribery-related money laundering charges following a jury trial.
  • Led the investigation and prosecution of a subsidiary of a multinational conglomerate, resulting in a deferred prosecution agreement, coordinated resolutions with the SEC and the Office of the Comptroller General of Brazil and global penalties of more than $160 million.
  • Led the investigation and prosecution of a leading global oilfield service company, resulting in a parent-level deferred prosecution agreement, subsidiary-level guilty plea, coordinated resolutions with authorities in Brazil and global penalties of more than $296 million.
  • Supervised the investigation and prosecution of a Colombian investment bank, resulting in a deferred prosecution agreement in the U.S., the first-ever coordinated resolution with authorities in Colombia and total global penalties and monetary payments of more than $80 million.
  • Supervised the investigation of a coal mining company, resulting in a Corporate Enforcement Policy declination for the company and FCPA charges against two employees.
