Biography

Jay has extensive experience conducting complex cross-border commercial litigation, insolvency disputes and international arbitration, with a particular focus on the energy sector.

Jay is also highly experienced in data protection, privacy and cybersecurity matters and is an accredited Certified Information Privacy Professional (CIPP/E). She regularly advises multinational clients, including within the technology, finance, cybersecurity and artificial intelligence (AI) sectors, on U.K. and European Union (EU) legislation and regulation.

Jay also maintains a significant pro bono practice and was recognized as Akin’s Pro Bono Associate of the Year for 2024. Her work includes advising and advocating for her clients in contractual, family and immigration related disputes.

Representative Work

International Disputes

  • Secured a winding-up order in respect of Galapagos S.A., in a decision marking a major milestone in an almost three-year cross-border insolvency dispute before the English, German and European courts. The judgment determined the extent to which pre-Brexit jurisprudence should still be considered retained in, or relevant to, English law.
  • Acted for Dr Lynch, Autonomy Corporation’s former CEO, in the U.K.’s highest value civil trial to-date and connected U.S. criminal proceedings, in connection with allegations of fraud linked to Hewlett Packard Enterprise’s $11.7 billion acquisition of Autonomy Corporation in 2011.*
  • Represented a fund’s portfolio company in a $1 billion Paris seated International Chamber of Commerce (ICC) arbitration concerning enforcement of a stabilisation provision in respect of tax measures directed to offshore natural gas production.
  • Representing a private fund in a high-value international joint venture ICC arbitration.

Cyber Security, Artificial Intelligence and Technology

  • Advising a variety of clients on navigating personal data breaches/cyber incidents, including on related reporting obligations in the U.K. and EU.
  • Advising a wide range of clients in relation to implementing supplementary measures or other amendments to their international data transfers post Schrems II.
  • Assisting numerous clients with data sharing arrangements with supplier/vendor and other partners in compliance with European privacy laws.
  • Advised a leading developer and manufacturer of smart speakers on an in-app update of its terms and conditions and related legal issues.
  • Advising a not-for-profit focused on developing a new ecosystem operating under a paradigm of human autonomy and agency via computational systems on the EU White Paper regulating AI.

  • Presented to a group of over 100 Zimbabwean and Zambian Lawyers on the extra-territorial reach of the U.K. and EU General Data Protection Regulation (GDPR), as part of a pro-bono initiative funded by the U.K.’s Foreign and Commonwealth Office.
  • Presenter and judge on the Lawyers Without Borders Wildlife Crime trial advocacy program, training 30 shortlisted Kenyan public prosecutors and criminal defence advocates.
