Biography
  • First-chair litigator and trial lawyer with extensive experience in high-stakes commercial disputes involving trade secrets, restrictive covenants, breach of contract, breach of fiduciary duty, worker classification, privacy and fraud.
  • Represents companies in a range of industries, with a particular focus on technology, health care and life sciences, investment management and professional services.

Laura has more than 15 years of experience guiding public and private companies through complex and sensitive commercial disputes. She litigates matters from pre-litigation counsel and resolution through trial, before federal and state courts and arbitration panels, and has served as lead counsel to multiple Fortune 500 companies.

A seasoned trial lawyer, Laura has substantial experience litigating—and winning—on both the plaintiff and defense side, including three arbitrations in recent years. Two of her successful trial verdicts have been named “Top Defense Verdicts” of the year by the Daily Journal.

She represents clients in matters involving a variety of challenging legal issues, including:

Laura also maintains a robust pro bono practice focused on civil rights cases. Among other successes, she partnered with the ACLU of Southern California in two groundbreaking cases challenging police and prosecutorial enforcement of gang injunctions.

Laura received her J.D. from Yale Law School, where she was a senior editor of the Yale Law and Policy Review. Following law school, Laura served as a law clerk for Judge Richard A. Paez of the U.S. Court of Appeals for the 9th Circuit and Judge Dean D. Pregerson of the U.S. District Court for the Central District of California.

Prior to joining Akin, Laura served as co-leader of the trade secret and employee mobility practice at a leading Los Angeles-based law firm.

Representative Work
  • Representing Yipit LLC, a subsidiary of the Carlyle Group, in bringing an action for trade secret misappropriation in the Southern District of New York.
  • Representing Paul Hastings LLP against a legal malpractice claim in California Superior Court brought by a former client in the biotech start-up space.
  • Representing Twomagnets, Inc. (DBA “Clipboard”)—an online marketplace that matches healthcare facilities looking to fill shifts with healthcare workers looking to find them—in multiple putative class and collective actions alleging that the workers were misclassified as independent contractors.
  • Representing a Fortune Global 500 financial company in class action litigation involving California privacy laws.
  • Represented Lore, a healthcare app, in a trade secret dispute in Minnesota federal court. After filing a motion to dismiss on behalf of Lore, the case settled.
  • On behalf of DoubleLine Capital and its CEO, Jeffrey Gundlach:
    • Won an arbitration brought by former partners seeking more than $500 million, achieving a complete defense award as well as victory on counterclaims that significantly reduced the value of the partners’ outstanding equity after a two-phase, multi-week hearing.
    • Secured a $66.7 million jury verdict in favor of Mr. Gundlach against his former employer, Trust Co. of the West (TCW), on his cross-complaint. TCW originally brought suit against Mr. Gundlach, DoubleLine Capital and certain of its founders, claiming breach of fiduciary duty, trade secret theft and tortious interference in connection with a large-scale departure of employees to DoubleLine Capital after Mr. Gundlach was terminated. The jury awarded no damages on TCW’s complaint against DoubleLine Capital and the individual defendants. The Daily Journal named this one of the top defense verdicts of the year.
  • On behalf of the Estate of Etsuko Toguri, obtained a $30 million award of compensatory damages, punitive damages and interest in AAA arbitration against a former partner for breach of contract, breach of fiduciary duty and fraud for failing to pay share of partnership property. The case involved the sale of a $45 million parcel of land in Rancho Cucamonga. The arbitration award was confirmed by the Los Angeles Superior Court in September 2022 and named a Top Verdict of the Week by the Daily Journal.
  • On behalf of Amgen, obtained a favorable settlement, including a multi-year royalty, resolving a trade secrets dispute brought against a commercial-stage biopharmaceutical company involving an oncology drug on the eve of a lengthy jury trial.
  • Secured a complete defense verdict on behalf of Fortress Investment Group in a five-week bench trial in a lawsuit filed by a life settlement investment fund seeking more than $200 million in damages and bringing claims of breach of fiduciary duty, fraud, unfair competition, breach of contract and misappropriation of trade secrets. The Daily Journal named this one of the top defense verdicts of the year.
  • Won a motion to dismiss on behalf of Facebook in a pair of class actions in federal court challenging certain alleged practices concerning location-related data. This result was featured by the Daily Journal in its “Verdicts and Settlements” roundup.
  • On behalf of social media app Snap, won a motion to dismiss trade secret and related claims related to the Snap Maps application.
  • Represented a technology startup in defending a breach of supply agreement claim and bringing affirmative trade secret and fraud claims against a Fortune 500 public commodities company in arbitration. Ms. Smolowe negotiated a favorable settlement that resolved the case the day before the arbitration hearing.
  • On behalf of City National Bank, successfully resolved claims of misappropriation of trade secrets, breach of contract and unfair competition brought by Community Bank.
  • Represented a satellite technology manufacturer in bringing claims of misappropriation of trade secrets, breach of fiduciary duty and breach of contract against former employees who secretly launched a competitor and stole confidential information.
  • On behalf of Ten-X, an online real estate marketplace, obtained a preliminary injunction and then later a cash settlement, a public apology and certain ongoing restrictions in its lawsuit against Commercial Real Estate Exchange (CREXi) and its CEO alleging breach of contract, breach of fiduciary duty and misappropriation of trade secrets.
  • Represented Air Lease Corporation in resolving allegations of trade secret theft, aiding and abetting breach of fiduciary duty and unfair competition relating to the formation of the company after the founder retired from a competitor.
